Morning Proof

Please read these Terms of Service ("Terms") carefully before using Morning Proof ("the app", "we", "our", or "us"). By using the app, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using Morning Proof, you agree to these Terms. If you do not agree to these Terms, do not use the app.

2. Description of Service

Morning Proof is a habit tracking application that helps users build consistent morning routines through:

• AI-powered photo verification of completed habits
• Streak tracking and progress monitoring
• Optional health data integration via Apple HealthKit
• Optional app blocking features

3. User Accounts

You may create an account using Sign in with Apple. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Notifying us of any unauthorized use

4. Subscriptions and Payments

Premium Features: Some features require a paid subscription (Morning Proof Pro).

Billing: Subscriptions are billed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase.

Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions: You can manage and cancel your subscription in your Apple ID account settings.

Refunds: All purchases are processed by Apple. Refund requests must be directed to Apple according to their refund policies.

5. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to gain unauthorized access to the app or its systems
• Upload malicious content or attempt to interfere with the app's operation
• Misrepresent your identity or impersonate others
• Use the app in any way that could damage or overburden our services

6. AI-Powered Photo Verification

When using the photo verification feature:

• Photos are sent to Anthropic's Claude AI for analysis
• You grant us permission to process these images for verification purposes
• Photos are not stored after processing and are not used to train AI models
• Do not submit photos containing sensitive, inappropriate, or illegal content
• We reserve the right to reject or flag photos that violate these terms

7. Health Data

If you choose to connect Apple HealthKit:

• You authorize us to access the health data types you approve (sleep, steps, workouts)
• Health data is used solely for display within the app and goal tracking
• Health data is never transmitted to external servers
• You can revoke access at any time through iOS Settings

8. Intellectual Property

Morning Proof and its original content, features, and functionality are owned by Ryan Louis Krane and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

We do not warrant that the app will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Ryan Louis Krane shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from:

• Your use or inability to use the app
• Any unauthorized access to your data
• Any interruption or cessation of the service
• Any bugs, viruses, or other harmful code

11. Termination

We may terminate or suspend your access to the app immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the app will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last Updated" date. Continued use of the app after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
